Why English Language Proficiency Matters for DOT-Regulated Motor Carrier Companies

The U.S. Department of Transportation (DOT), through the Federal Motor Carrier Safety Administration (FMCSA), has recently made it clear: English language proficiency (ELP) is not just a formality - it’s a regulatory requirement that is now being enforced more rigorously by the current US administration. Motor carriers regulated by the DOT must understand and comply with ELP standards to stay compliant and ensure road safety. 

What Are the DOT's ELP Requirements? 

Under DOT regulation 49 CFR § 391.11(b)(2), all commercial motor vehicle (CMV) drivers must be able to read and speak the English language sufficiently to: 

  • Converse with the general public and law enforcement. 

  • Read traffic signs and signals. 

  • Understand official inquiries and respond appropriately. 

  • Complete necessary documents such as shipping papers and inspection reports. 

Recently, the FMCSA released additional guidance on how motor carriers should assess this proficiency. While many regulated employers may assume their drivers meet this standard, the DOT now expects companies to proactively verify English competency, particularly before allowing a driver to operate a commercial motor vehicle (CMV).

What DriverCheck Recommends 

At DriverCheck, we encourage all DOT-regulated motor carriers to take the ELP assessment seriously, especially given the increased scrutiny and enforcement. Here’s how your organization can strengthen its approach to ELP compliance:  

1. Conduct a Structured ELP Assessment 

Motor carriers should assess a driver's English proficiency during the hiring process and periodically during employment. This should include evaluating their ability to: 

  • Communicate verbally in English during a structured interview. 

  • Explain the meaning of U.S. road signs and safety instructions. 

  • Understand shipping documentation and vehicle-related forms. 

  • Respond appropriately to law enforcement and roadside inspections. 

2. Avoid Translation Tools During the Assessment 

Relying on interpreters, cue cards, or translation apps may mask a driver’s true proficiency and does not meet regulatory expectations. FMCSA has clearly stated that such tools should not be used during ELP assessments, as they interfere with accurately evaluating a driver’s ability to operate safely and independently. 

3. Addressing an ELP Deficiency 

If a driver is unable to meet the English language standard, they are not qualified to operate a CMV under DOT regulations. Beginning June 25, 2025, enforcement officers may place non-proficient drivers out of service on the spot. This means the driver will not be allowed to drive the truck to its intended destination or back home.  

In these cases, DriverCheck recommends the following approach: 

  • Provide support: Connect the driver with English language learning resources or training programs. 

  • Document efforts: Keep detailed records of what steps were taken to help the driver improve their proficiency. 

  • Reassess as needed: Once the driver demonstrates progress, conduct a follow-up assessment before returning them to service. 

Ensuring drivers meet English language requirements isn’t just about avoiding fines or out-of-service orders - it’s about safety. From reading road signs to interacting with emergency personnel, English proficiency directly affects a driver’s ability to perform essential tasks and respond to critical situations.
